بر اساس نسخه ای از دستورالعمل پیشنهادی اداره خدمات شهروندی و مهاجرتی ایالات متحده که به رسانه ها درز کرده است، این اداره قصد دارد تعریف عدم تمکن مالی و عوامل موثر بر تعیین آن را تغییر داده و اقامت دائم افرادی که ممکن است به Public charge تبدیل شوند را رد کند.
برخی از شاخصه های جدیدی که این اداره قصد دارد آن ها را در نظر بگیرد عبارتند از:
۱- استفاده از Medicaid.
Subsidized health insurance under the Affordable Care ActMedicaid (non-emergency services)
۲- استفاده از برنامه های غذایی مثل فوداستمپ.
Supplemental Nutrition Assistance Program (SNAP, formerly food stamps)
۳- بیمه ایالتی برای کودکان.
State Child Health Insurance Program (CHIP or SCHIP)
۴- کمک هزینه مسکن
Housing assistance
۵- کمک هزینه پرداخت قبوض انرژی
Energy benefits
۶- دریافت مبلغی مازاد بر مالیات پرداختی (Tax credit) پس از ارسال اظهارنامه مالیاتی سالیانه.
Earned Income Tax Credit (when it exceeds tax liability).

Trump Proposal Would Penalize Legal Immigrants for Getting Tax Credit Refunds
Under a new leaked version of the rule reportedly being considered, use of government benefits -- with few exceptions -- could hurt an immigrant's chances of becoming a permanent legal resident.
Under the latest proposal, legal immigrants could be considered a public charge if they benefit from an expanded list of government programs, including:
Federal Earned Income Tax Credit and "similar refundable tax credits"
State or local cash benefit programs
Medicaid
Government subsidies for health insurance
Children’s Health Insurance Program (CHIP)
Supplemental Nutrition Assistance Program (SNAP), formerly known as food stamps
Special Supplemental Nutrition Program for Women, Infants and Children (WIC)
Federal housing assistance, including rental vouchers
The Low Income Home Energy Assistance Program (LIHEAP)
would also allow the federal government to look back 36 months from the time of application for any use of government benefits -- up from 24 months in the last draft. And participation in Head Start is no longer penalized, as it was under the previous proposal.
It affects applications for permanent legal status, but not for citizenship, which is a different process. If someone's green card application is denied, it stops the process of becoming a legal permanent resident, and in some rare circumstances, it could even lead to deportation.
